Professional experience

Andrey Mikoni heads S&K Vertical’s litigation practice, he is an expert in the area of commercial litigation and arbitration, has an extensive experience of acting in higher courts, the Supreme Court of the Russian Federation and the Supreme Commercial Court of the Russian Federation, in international commercial arbitration, in organizing litigation in foreign jurisdictions. Andrey coordinates litigation teams in complex disputes with the transnational component and in bankruptcy proceedings.

Andrey Mikoni graduated from the Law Department of the St. Petersburg State University in 2006.


  • acted in the Supreme Commercial Court of the Russian Federation in a dispute between the owner and the St. Petersburg City Administration regarding the vindication of real estate objects that had been alienated by criminal acts. In its decision the Presidium of the Supreme Commercial Court for the first time in judicial practice determined the exhaustive list of actions necessary to effectively protect the rights of the plaintiff; for the first time in judicial practice the court considered the issue of transferability of such an object as ’unit’, including the possibility of its vindication when the external boundaries of the object have been changed;
  • represented the Client in the dispute with a bank (top-10) regarding compensation of losses related to the theft of money by letter of credit; Andrey was able to prove that the bank’s actions aimed at preventing the crime were insufficient and that the letter of credit and the underlying contract were legally interconnected;
  • represented one of the largest CIS banks in a dispute with the owner of a five-star hotel seeking recovery under loan agreements and bills and foreclosure of pledged shares, the amount of claims exceeded $ 100 million;
  • represented the largest Russian social network in a dispute with the World’s largest record companies regarding compensation for infringement of copyright and removal of illegally placed tracks, as well as in a dispute with the data center;
  • represented Russia’s largest retailer of electronic equipment in a dispute with the federal mobile operator. In the course of this conflict, the claims have been presented to the opponents concerning infringement of the client’s exclusive rights for a total of $ 1 billion. The dispute was settled amicably;
  • represented the Judicial Department of the Supreme Court of the Russian Federation in a dispute with the contractor for the construction of the City Court building in St. Petersburg to recover unjust enrichment in the budget, the case turned to be precedent-setting with respect to the possibility of unilateral termination of the state contract and the powers of officials to change it;
  • represented a scientist in a dispute with the leading Russian media regarding protection of business reputation and recovery of damages;
  • represented the advertisers in a dispute with the Government of St. Petersburg, which was considered by the Supreme Court of the Russian Federation, and also in challenging the auction held by the Antimonopoly Service, which eventually cancelled the auction;
  • represented a client in a dispute with a bank (top-10) in connection with compensation of judicial costs; the client was awared a record-setting compensation of judicial costs;
  • represented the creditor (a top-10 bank) in insolvency cases of a group of enterprises, including the side disputes regarding mortgages and guarantee agreements, and successfully secured the status of the creditor for the subsequent recovery, the amount of the debt is 2,5 billion rubles.
